Terms of Service
Last updated: 25 September 2026
The short version
- OpenWill helps you organise your wishes and create a will. Creating your will is free.
- We are not a law firm and we don't give legal advice. Your will is only valid once you sign it and have it witnessed properly under the law of your country.
- Live Will is an optional paid membership that checks in with you and, after two of your executors confirm, releases the right documents to the right people.
- Live Will does not replace probate or give anyone legal authority over your estate.
- You can cancel your membership at any time. Your statutory consumer rights are not affected by these terms.
1. About these terms
These terms explain how you can use OpenWill, including the website at openwill.app and any related apps and services (together, the "Service"). By creating an account you agree to these terms, our Privacy Policy and our Acceptable Use Policy. If you buy a Live Will membership, our Membership & Subscription Terms also apply.
Please read them carefully. If you don't agree, please don't use the Service.
2. Who we are
OpenWill is operated by NEOCR LTD, a company registered in England and Wales under company number 15664816, operating as a digital-only business with no public visitor address ("OpenWill", "we", "us", "our").
You can contact us at support@openwill.app.
3. Who can use OpenWill
To create an account you must:
- be at least 18 years old, or the minimum age for making a will where you live, if that's higher;
- be creating a will for yourself, not for someone else;
- have the mental capacity to make decisions about your property and your will; and
- give us accurate information about yourself.
You can't use OpenWill if you're located in, or ordinarily resident in, a country or region subject to comprehensive UK, US or UN sanctions, or if you're on a sanctions list.
OpenWill is available worldwide. We provide country-specific will wording for England and Wales, Scotland, Northern Ireland, Ireland, the United States, Canada, Australia and South Africa. For other countries, we provide general wording that may need to be adapted by a local lawyer before it will work under your local law. We'll tell you which applies when you choose your country.
4. What OpenWill does
OpenWill gives you tools to:
- record your assets and wishes in your own words and organise them into an inventory;
- name and privately invite executors, beneficiaries and witnesses, and see when they confirm;
- produce will wording designed for the country you select;
- follow guidance on how to sign and witness your will; and
- arrange an optional independent legal review with a third-party provider.
Our optional Live Will membership also lets you:
- complete regular check-ins so we know you're well;
- store documents in a private vault; and
- have those documents released to the right beneficiaries, only after two of your executors have independently confirmed.
5. What OpenWill does not do
It's important you understand the limits of the Service.
- We don't give legal advice. We are not a law firm, we are not regulated by the Solicitors Regulation Authority or any other legal regulator anywhere in the world, and using OpenWill does not create a solicitor-client relationship. See our Legal Disclaimer.
- We don't make your will valid. A will made with OpenWill only becomes legally valid when you sign it and have it witnessed correctly under the law that applies to you. The rules differ between countries, and in some countries (such as the United States) between states. Many places require you to sign a printed copy in front of two independent adult witnesses, who then sign it themselves. Some also require or allow a notary. In most places, a beneficiary (or their spouse or partner) should not act as a witness.
- We can't override local inheritance law. In some countries, forced heirship rules, or religious or customary law, decide who inherits part or all of an estate, whatever a will says.
- We don't store a paper original of your will. Live Will stores the completed, electronically signed and sealed PDF in its private vault. Where local law requires a paper original or does not recognise electronic signing, you're responsible for signing and keeping that original safe and telling your executors where it is.
- We aren't your executor, and we don't manage, hold or transfer any of your assets.
- Live Will does not replace probate. Releasing documents through Live Will doesn't give anyone legal authority to deal with your estate. Your executors may still need to apply to a court or registry for legal authority, such as a grant of probate, letters of administration or letters testamentary, depending on your country.
- We don't give tax or financial advice, including on inheritance tax.
6. Your account
You're responsible for keeping your login details secure and for everything that happens under your account. Please use a strong, unique password and keep access to your email account secure, because that's how we'll contact you and how account recovery works.
Tell us straight away at security@openwill.app if you think someone else has accessed your account.
7. Creating your will: your responsibilities
You are responsible for:
- making sure the information you give us is accurate and complete;
- reading and checking your will carefully before you sign it;
- signing and witnessing your will correctly under the law that applies to you;
- keeping your original signed will safe and making sure your executors can find it; and
- keeping your will up to date.
Major life events can affect your will, including marriage, civil partnership, divorce, separation, having children, moving country, or buying or selling significant assets. In some places, including England and Wales, getting married will usually cancel an existing will. Please review your will whenever your circumstances change.
If your situation is complex (for example, you have assets in more than one country, business interests, trusts, dependants with care needs, you're subject to forced heirship, religious or customary inheritance rules, or you expect your will to be challenged), we strongly recommend you get independent legal advice from a lawyer where you live.
8. Inviting other people
When you invite executors, beneficiaries or witnesses, you're asking us to contact them on your behalf. By doing so, you confirm that:
- the contact details are correct and you're allowed to share them with us; and
- you're happy for us to tell them that you've named them in your plans, to the extent the invitation requires.
People you invite can decline, and can ask us to remove their details. They'll only see the information you choose to share with them, and beneficiaries will only ever see their own allocations. Our Privacy Policy explains how we handle their information.
9. AI features
OpenWill uses artificial intelligence to help turn your descriptions of your assets into an organised inventory, and may use it for other features. AI can make mistakes. Always check what it produces before relying on it or including it in your will. The final content of your will is your decision and your responsibility.
10. Live Will membership
Live Will is a paid, optional membership. How it's billed, renewed and cancelled is set out in our Membership & Subscription Terms.
How release works. While your membership is active:
- We ask you to check in at the frequency you choose: weekly, fortnightly, monthly or quarterly.
- If you miss a check-in, we send reminders during your chosen grace period of 1, 3 or 7 days using the contact methods on your account.
- If you still don't respond, we contact your nominated executors.
- Two of your executors must each independently confirm your death through the Service and provide an official death certificate or equivalent evidence. OpenWill staff review that evidence.
- Nothing is released until OpenWill has reviewed the evidence and both confirmations. We pause the release if the account holder contacts us to report they are alive.
- Documents are then released to each beneficiary according to your instructions. Each beneficiary only sees the documents and allocations you've assigned to them.
Limits of Live Will. Live Will depends on accurate contact details, on you checking in, and on your executors acting honestly and promptly. We take care to make release safe and reliable, but we can't guarantee that release will happen at a particular time, or that it can't be triggered by people acting dishonestly together. Please choose executors you trust, and keep everyone's contact details up to date.
If your membership ends, Live Will stops working. Check-ins stop, and your documents will not be released after your death. See our Membership & Subscription Terms for what happens to your vault.
11. Fees
Creating your will on OpenWill is free. Live Will membership costs £6.99 a month or £59.99 a year, or the local-currency price shown to you before you buy, where available. If you pay in a different currency from the one we charge in, your bank may add conversion fees.
Paddle.com Market Limited ("Paddle") is the Merchant of Record and reseller for all orders and subscriptions placed through the Service. Our order process is conducted by our online reseller, Paddle.com Market Limited. Paddle.com is the Merchant of Record for all our orders: Paddle is the seller of Live Will membership for payment purposes, appears on your card or bank statement, and provides customer service enquiries relating to orders and handles returns, including invoicing and refunds. Payment, billing, tax, cancellation and refund mechanics are also governed by Paddle's Buyer Terms. Depending on where you live, VAT, GST or sales tax may be included in the price or added at checkout. Paddle calculates and shows the applicable tax and total before you pay. We don't store your full card details.
12. Independent legal review
If you choose to arrange an independent legal review, it will be carried out by a third-party provider who is not part of OpenWill. That provider will have their own terms, and their advice is their responsibility, not ours. OpenWill does not currently receive a referral fee or commission from independent reviewers.
13. Your content
You own the information and documents you add to OpenWill ("Your Content"). You give us permission to store, process, copy and display Your Content only as needed to provide the Service to you and to the people you've chosen, including releasing it under Live Will. We don't claim ownership of Your Content, and we don't sell it.
You confirm you have the right to upload Your Content and that it doesn't break any law or anyone else's rights.
14. Our content
The Service, including our software, design, text, templates and branding, belongs to us or our licensors. You can use the will wording we generate for you to make your own will. You can't copy, resell or reuse our Service or templates for anyone else or for commercial purposes.
15. Availability and changes to the Service
We work hard to keep OpenWill available and secure, but we can't promise it will always be available or error-free. We may need to suspend access for maintenance, security or reasons outside our control.
We may change or improve the Service. If we make a change that significantly affects a paid feature you rely on, we'll tell you in advance and you can cancel and receive a pro-rata refund for any unused period you've paid for.
If we ever decide to close OpenWill, we'll give you at least 90 days' notice and a way to download your information.
16. Our responsibility to you
We provide the Service with reasonable care and skill. If we fail to comply with these terms, we're responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited under the law, including your rights under the Consumer Rights Act 2015 or the consumer protection laws of the country where you live.
Subject to that, we are not responsible for:
- a will being invalid, or not reflecting your wishes, because it wasn't signed or witnessed properly, because information you gave us was wrong or incomplete, or because your circumstances changed and you didn't update it;
- decisions you make without taking independent legal, tax or financial advice where it was needed;
- the actions of your executors, beneficiaries, witnesses, or any third-party legal reviewer;
- losses caused by events outside our reasonable control; or
- losses that weren't foreseeable, or business losses. OpenWill is for personal use only.
Subject to the paragraph above headed "Nothing in these terms limits our liability", our total liability to you for any claim relating to the Service is limited to the greater of £100 or the total fees you paid us in the 12 months before the claim.
17. Suspending or ending your account
You can close your account at any time from your account settings or by emailing support@openwill.app. See our Data Retention & Deletion policy for what happens to your information.
We may suspend or close your account if you seriously or repeatedly break these terms or our Acceptable Use Policy, if we're required to by law, or if we reasonably suspect fraud, including a false report of death. Where it's reasonable to do so, we'll tell you first and give you a chance to put things right.
18. If you die
When we're told that an account holder has died, we'll act in line with their instructions on the Service and our Executors & Bereavement Support process. We'll stop taking membership payments once we have reasonable evidence of death, and any unused portion of an annual membership can be refunded to the estate on request.
19. Changes to these terms
We may update these terms from time to time, for example to reflect changes in the law or in the Service. If a change materially affects you, we'll tell you at least 30 days before it takes effect. If you don't agree, you can close your account and cancel any membership before the change takes effect, and we'll refund any unused portion you've paid for.
20. Complaints
If you're unhappy with anything, please tell us. Our Complaints Procedure explains how we'll handle it.
21. General
- Transfer. We may transfer our rights and obligations under these terms to another organisation, for example if our business is sold. We'll tell you if this happens, and it won't reduce your rights.
- Third parties. These terms are between you and us. No one else, including your executors or beneficiaries, has any right to enforce them.
- Severability. If a court finds part of these terms invalid, the rest will still apply.
- No waiver. If we delay enforcing any part of these terms, we can still enforce it later.
22. Governing law
These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales.
If you're a consumer living outside England and Wales, you still benefit from any mandatory protections under the law of the country where you live, and you may be able to bring proceedings in your local courts. Nothing in these terms takes away those rights.
The law that governs your will is separate from these terms. It depends on where you live, where your assets are, and the country you choose when you create your will.
